Policy statement

This privacy policy exists to protect you. It defines how your information is permitted to be used, and how it is protected. iClick2Learn regards privacy as an important part of our relationship with our stakeholders. The following privacy policy applies to all iClick2Learn customers, team members, and contractors. This information conforms to Internet privacy standards, Cyber security best practices and related legislation for NSW and the Australian Government. 1. How we store and protect your privacy and data

We are committed to protecting your privacy. We will keep private and secure any personal information we gather about you. This policy informs our team and contractors how we protect your privacy and your data. We use cyber security best practices with all our software subscriptions that may contain your data. As much as possible, we store your information using Australian Servers. Our team receives training in cyber security and information privacy and security. We have cyber security systems on our website to mitigate the risk of hackers and data breaches. Our website, firewall, Sucuri protects your data. This provides:·
  • Denial of Service (DoS)
  • Cross Site Scripting (XSS)
  • Remote / Local File Inclusion (RFI/LFI)
  • SQL Injection (SQLi)
  • & other Software Vulnerabilities
  • Malware
To ensure the integrity of our site, it is also scanned daily for spam and online phishing reputation and block listing. The security of your personal information is important to us. When you enter sensitive information (such as credit card numbers) on our website, we encrypt that information using secure socket layer technology (SSL). When Credit Card details are collected, we simply pass them on in order to be processed as required. We never permanently store complete Credit Card details. We follow privacy standards to protect the personal information submitted to us, both during transmission and once we receive it. Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure. When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.  We dispose of your information in accordance with legal requirements.

2. Your responsibility

The systems we use to protect your privacy and data are also the systems that are used to allow multiple user log-ins. You are responsible and must ensure you maintain the privacy and integrity of your account information. You are not allowed to share your account information or details with anyone. You are not allowed to share our products and services with others, or our paid services including the online library resources, without our expressed written permission. Any sharing without permission is considered a breach of this policy and may result in us cancelling your account and preventing you from accessing further products and services with us. To protect our members’ personal data, we are introducing limiting the number of active logins from an individual account. This is a similar concept as blocking multiple login attempts to protect against brute force attacks. This means single logins should not be shared at the risk of having blocked access as well as password protection best practices.

3. Consent

By providing personal information to us, you consent to the collection, use and disclosure of your personal information in accordance with this Privacy Policy and any other arrangements that apply between us (such as an invoice or contract for other training products). You give consent at the time you provide the information to us. This can be in person during a training workshop or in our online website checkout page. We may change our Privacy Policy from time to time by publishing changes to it on our website and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances we disclose it. We reserve the right to modify this privacy statement at any time, so please review it frequently. If we make material changes to this policy, we will notify you in our newsletter. We recognise that some people may choose anonymity, and we respect your right to do this. Where possible, and agreed to by our stakeholders or clients, for example in satisfaction surveys, we provide an opportunity to share information with us anonymously. You can also sign up as a member of our site and participate in our online workshops with a pseudonym. We also don’t pressure you to speak or show your face in our online workshops and provide alternate ways to ask questions anonymously.

4. Collection of Information

Any information collected by iClick2Learn that is collected from you or your company is securely stored. This may be information received in person or via the phone, email, mail, social profiles and groups, or directly through our website. We may receive information via a third party, for example, by a client to communicate with you about the project we are delivering on their behalf. In that situation, we will take reasonable steps to ensure that you are made aware of the source of your information.

5. Purpose of data collection

We collect your Personal Information for the primary purpose of providing our products and services to you, providing information to our clients, funders and stakeholders, and for marketing and communication. When we collect Personal Information, we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it or provide you with a reference and/or link to this policy. a.Primary Purpose In order to use the iClick2Learn our products and services, we require information from you, so we can provide the best service possible. The primary purpose of the collection of information is to:
  • Enable you to access our products and services
  • Receive event and news information from us
  • Attend events and activities we host or support
  • Send you administrative messages such as reminders, updates, technical or support information
  • Respond to requests
  • Send you marketing information that you may unsubscribe from
  • Use event photography, use testimonials or feedback either de-identified or identified with consent.
  • To use in the normal course of business such as applications or contracts.
  • To assess the efficacy of the outcomes of our products and services
b.Secondary Purpose We only collect and share information for a secondary purpose where it is connected to our primary purpose and you have either consented, or there is a reasonable expectation for us to collect and disclose that information for the secondary purpose. The most common secondary purposes are where our client is providing people with subsidised or free access to our products and services and we need to provide our client with data reports on your interaction, engagement and usage of the site. Other examples for which we may collect additional information in a survey or a sign-up form are where our client has requested this information, or it is required to report to funding agencies around performance indicators or funding criteria.

6. What information we collect

We collect information from you in person, or online. Information we collect depends on the purposes for collection stated above. We require the following information to access our products and services directly from us, or on behalf of a client who we are providing services to. a.Personal information: Personal Information is information or an opinion that identifies an individual. This information can include opinions and feedback from you that are reasonably identifiable. For example, your name, email address, phone number, postcode or town. We may de-identify your information for reporting or other purposes. Where this is done, this is no longer personal or sensitive information that is attributable to you. b.Sensitive information Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information. Sensitive information will be used by us only:
  • For the primary purpose for which it was obtained
  • For a secondary purpose that is directly related to the primary purpose
  •  With your consent, or where required or authorised by law.
  1. Financial information:
If you purchase a product or service from us, we may request certain personally identifiable information from you. You may be required to provide contact information (such as name, Email, and postal address) and financial information (such as credit card number, expiration date). We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you. iClick2Learn uses the Stripe Payment Gateway for its online credit card transactions. Stripe processes online credit card transactions for thousands of Australian merchants, providing a safe and secure means of collecting payments via the Internet. All online credit card transactions performed on this site using:
  • the Stripe gateway are secured payments.
  • Payments are fully automated with an immediate response.
  • Your complete credit card number cannot be viewed by iClick2Learn or any outside party.
  • All transactions are encrypted under AES-256 over HTTPS.
  • All transaction data is encrypted for storage within Stripes bank-grade data centre, further protecting your credit card data.
  • Stripe is an authorised third party processor for all the major Australian banks.
  • Stripe at no time touches your funds; all monies are directly transferred from your credit card to the merchant account held by iClick2Learn.

  1. Characteristic identification
From time-to-time we may need to collect characteristic identification information from you. When we ask this information, we generally ask it in a way that can be provided anonymously, unless you choose otherwise. Examples of characteristic identification include how you identify yourself from a cultural, racial, disability or gender/non-binary perspective. We only collect this data when it is necessary for the purposes of programs and services we deliver on behalf of clients, or for targeted and funded programs such as a program that is specifically for Aboriginal and Torres Strait board members. We may also ask this information from time-to-time to ensure that we are meeting individual needs and for the purposes of improving our products and services. c.Website usage data We also collect information through our website. This can include your geo-location information, computer and connection information, statistics on page views, course progress, traffic to and from our sites and data, IP address and standard website log-in information. We also use third party tools to collect information such as Google Analytics and cookies. When you accept cookies from our site, you are consenting to provide us with statistical information that is identifiable to your account (real or pseudonym) and may be used for primary or secondary purposes. You can decline cookies if you choose to have us collect your data anonymously, however this may disable some of the website functionality.

7. How we use and disclose information

a.Use We use information to assess the efficacy of our products and services. We access information about website user behaviour, pages viewed, log in details, course progress. iClick2Learn uses personally identifiable information for communication and marketing. In accordance with the secondary purpose, we also provide reports to our clients for project analysis or funding efficacy purposes. b.Third party disclosure We may disclose your information to third party services or software providers, such as survey software systems, CRM or email marketing systems. We do this where it is connected with our primary and secondary purpose. You will be notified when your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice to share your information with that party, or not. We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our company. iClick2Learn may at its discretion use other third parties to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service. These third parties are prohibited, and agree to terms and conditions, not to access and use your personally identifiable information for any other purpose. iClick2Learn does not share any information with third parties for any unknown or unrelated uses. Links on the iClick2Learn site to external entities are not covered within this policy. The terms and conditions set out in this privacy statement only cover the domain name of iClick2Learn.com. We do not guarantee or warrant your privacy or data security on these sites.

8. Access to your information

At any time you may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If your personally identifiable information changes, or if you no longer desire our service, you can opt-out and unsubscribe. You can also delete your membership account on our website. If you wish to access your Personal Information, please contact us in writing. iClick2Learn will not charge any fee for your access request, but will charge a $75 administrative fee for providing a copy of your Personal Information. In order to protect your Personal Information we will require identification and confirmation of that in writing from you before releasing the requested information.
