How to comply with the new Associations Incorporations Act, 2015 (WA)

The introduction of a new Associations Incorporations Act for Western Australia has resulted in some considerable changes across the state. We know how confusing all the information can be for everyone to understand given the range of new compliance matters that have been included. This course focuses on those areas that the Act states a breach of clauses within the act could result in consequences such as a fine or legal action for example.

To help you understand what the Act states in terms of what you need to comply with we've simplified this into what we call 'trigger events'. These are events that happen in your not-for-profit which could result in non-compliance if you didn't know about it.

For example, if you are holding an AGM that's a trigger event, as there are a few things you must do in order to comply with the Associations Incorporations Act 2015 (WA). Don't forget you'll also have elements within your constitution as well, which won't be covered by this course as each constitution differs and it would be useful for you to use a similar 'trigger event' framework we've used when you consult your constitution either during, or after you do this course.

If you are thinking about updating your constitution, you could also undertake the below course on updating your constitution which provides you with a template constitution and support from our legal professional, solicitor Dominic Cudmore of Hart Legal, who is available to support you and answer any questions you may have during this process.

This course was produced in November 2017 in partnership with Linkwest. The author of this course is a governance consultant and provides practical suggestions and examples of what you could consider in complying with the Act. By undertaking this course you understand that the information provided to you does not substitute for your own inquiry or the advice of a legal practitioner. Every attempt has been made to ensure that this information is up-to-date and is sourced from reliable sources, with a solicitor's review of the final material, however, it is provided 'as-is' with no guarantee of completeness, accuracy or timeliness.
